Upon failure of the Plaintiff to appear for trial as set forth above, said cause shall be dismissed for want of prosecution pursuant to Rule 165a, TEXAS RULES OF CIVIL PROCEDURE. Further, if any Defendant fails to appear for trial as set forth above, the opposing parties may request appropriate relief and default may be entered No continuances will be considered without the filing of a proper motion for continuance and order by the Court. A courtesy copy of such notebook for the Court's use is not required. Documentary/ photo exhibits must not be larger than 8"x 11 ". IT IS FURTHER ORDERED that all dispositive motions, including motions for summary judgment, and motions challenging any designated expert witness, or their testimony, must be heard by the Court no later than thirty (30) days prior to the beginning of final trial. Failure to do so shall constitute a waiver. Any motion challenging an expert witness, on any grounds, must be filed at least twenty (20) days prior to the hearing date and the non-moving party must file their response to such challenge, including exhibits and affidavits, no later than five (5) days prior to the hearing date.
